Terms of Service

1. Acceptance of terms

By creating an account or using Smookie Live ("the Platform"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 13 years old to create an account. Users aged 13–17 may only sell on the Platform through our special Teen Seller application process with verifiable parental or guardian consent — see our Teens on Smookie Live policy. By using the Platform, you represent that all information you provide is accurate.

3. Content policy

Smookie Live is an educational and shopping platform. The following are strictly prohibited on all streams, chats, and listings:

• Adult, sexually explicit, or nude content of any kind.
• Hate speech, harassment, bullying, or discriminatory content.
• Violence, self-harm content, or content promoting illegal activity.
• Counterfeit goods, stolen items, or items you do not have the right to sell.
• Spam, scams, or misleading claims about a product's condition, authenticity, or value.

We may remove content, suspend, or permanently ban accounts that violate this policy, at our sole discretion.

4. Tokens

Tokens are a virtual currency used to access paid streams, send gifts to streamers, and bid on or purchase items in Live Shopping. Tokens have no cash value outside the Platform, are non-transferable between accounts, and are non-refundable except where required by law. We reserve the right to adjust token pricing or the token economy at any time.

5. Live Shopping and seller obligations

• Sellers must be approved by our team before listing items via auction or fixed price.
• Sellers must honor completed sales and giveaways, and ship purchased items within the timeframe stated at checkout (typically 2 business days).
• Buyers are responsible for shipping costs unless the seller states otherwise.
• Smookie Live charges a commission of 4%–8% on completed sales, depending on category and country, deducted automatically from the seller's proceeds.
• Disputes between buyers and sellers should first be raised via a support ticket; Smookie Live may mediate but is not a party to the underlying sale.

6. Streamer conduct

If you stream on Smookie Live, you are solely responsible for the content you broadcast, including via camera, screen share, or external platform embeds. You must have the rights to any music, footage, or material you display during a live stream.

7. Account suspension and termination

We may suspend or terminate your account, with or without notice, if you violate these Terms, engage in fraudulent activity, or create risk or legal exposure for Smookie Live or other users. You may delete your account at any time by contacting support.

8. Intellectual property

You retain ownership of content you upload, but grant Smookie Live a worldwide, non-exclusive, royalty-free license to host, display, and distribute it as necessary to operate the Platform (e.g. displaying your stream to viewers). The Smookie Live name, logo, and platform design are our property and may not be used without permission.

9. Disclaimers

The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service, and we are not responsible for the accuracy of content posted by streamers or sellers, or the quality of items sold through Live Shopping.

10. Limitation of liability

To the maximum extent permitted by law, Smookie Live shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including loss of tokens, data, or profits.

11. Changes to these terms

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
